Terms of Business

In these Terms and Conditions and throughout this website, Pharmaid Natural Cosmetics UK™ means Body and Mind Studio International Ltd (company number 06757605 registered in England and Wales with it's registered office at 16-18 Langton Place, Bury St Edmunds, Suffolk IP33 1NE) trading as Pharmaid Natural Cosmetics UK™; “Goods” means the goods and/or services to be supplied by  Pharmaid Natural Cosmetics UK™ to the Client in accordance with goods and/or services offered on the Pharmaid Natural Cosmetics UK website, leaflets and/or other verbal/written communications; and “the Client” means the person who accepts a Pharmaid Natural Cosmetics UK™ quotation, website(s) and/or leaflet pricing for the supply of Goods or whose order for the Goods is accepted by Pharmaid Natural Cosmetics UK™ and where the Client comprises two or more persons their liability shall be joint and several.

These Terms and Conditions apply to all contracts for the sale of Goods to, or the provision of work for the Client, to the exclusion of any terms and conditions specified by the Client.
  

1. Pharmaid® Greek Cosmetic Products.

1.1 Pharmaid Natural Cosmetics UK™ are distributors for the Pharmaid Premium Natural Products range which are imported from Kandyli Ialysos, 85101 Rhodes, Dodecanese, Greece. These include, but are not limited to all products in the ranges of Aegean SunAloe Treasures, Argan TreasuresAthena's Treasures, Donkey Milk Treasures, Dream Tan, and the Pharmaid Wellness range of products.  All of these products supplied by Pharmaid Natural Cosmetics UK™ are offered subject to availability and orders shall be deemed to be accepted only when Pharmaid Natural Cosmetics UK™ either (a) makes arrangements with the buyer for the goods to be physically delivered to the Named Place of Destination or (b) despatches the goods to the Named Place of Destination, whichever shall be the earlier.


1.2 The prices and other terms stated in our price lists and/or websites apply to their relevant markets and are subject to alteration at any time without prior notice. Goods will be invoiced at the prices ruling at the date of order and country specific taxes (where applicable) charged at the rate(s) ruling at that date.

1.3 Any special promotional terms which differ from the terms set out in our price lists and/or websites are subject to availability on acceptance of any order and no contract involving any such promotional terms shall exist until the order is accepted by the issue of an invoice as provided above.

1.4. Pharmaid Natural Cosmetics UK™ will not be bound by any variation of these terms and conditions unless its agreement to such a variation is recorded in writing and signed by a Director of Pharmaid Natural Cosmetics UK™.

1.5 All orders are delivered carriage paid. Goods should always be checked at time of delivery. Both the carrier concerned and Pharmaid Natural Cosmetics UK™ must be advised, in writing, otherwise than on a consignment note or delivery receipt, WITHIN THREE DAYS OF DELIVERY, of any shortage, damage, or mis-delivery. If an entire consignment is not received within 21 days of invoice date, written notice must be sent to Pharmaid Natural Cosmetics UK™ at once. CLAIMS RECEIVED OUTSIDE THESE LIMITS CANNOT BE CONSIDERED.

1.6 Title in the Goods shall pass to the Client upon the Goods leaving the Pharmaid Natural Cosmetics UK™ premises. 
 
2. Gift Vouchers/Gift Certificates

2.1 Gift Vouchers purchased from Pharmaid Natural Cosmetics UK™ either in person or via the online store accessed via the company website at www.pharmaiduk.com are valid for 120 days from the date of purchase.

2.2 Gift vouchers may not be redeemed for money or refunded to the purchaser. They may only be used for products or services available at the time of use at Pharmaid Natural Cosmetics UK™.

2.3 Gift vouchers may only be redeemed for products or services at the prices applicable on the day of use which can be found at www.pharmaiduk.com.
 
3. Special Offers/Stock Clearance Sales

3.1 From time to time, Pharmaid Natural Cosmetics UK™ run special offers and/or promotions. Only one special offer or promotion may be used at any one time.

3.2 Due to the greatly reduced prices, items purchased at the reduced sale rates are 100% non-refundable.
 
3.3 Our stock clearance sale items consists of many products which are near to or past their "best before date" and some which are just in the sale. Many items are greatly reduced to clear to allow us to purchase new stock. Just click on the products and you will see what price we have reduced them from. All products in the sale have been on sale at the pre-sale price for a minimum of 90 days prior to the original start of sale date. 

4. Copyright

4.1 The copyright and all other rights in the material on the Pharmaid Natural Cosmetics UK™ website (www.pharmaiduk.com) are owned by Pharmaid Natural Cosmetics UK™ or are included with the permission of the owner of the rights wherever possible. As a visitor to the website, you may download a single copy of the material for your own private viewing purposes only. No copying or distribution for any commercial or business use is permitted without written consent of Pharmaid Natural Cosmetics UK™.

4.2 All trade marks used on the Pharmaid Natural Cosmetics UK™ website (www.pharmaiduk.com) are the property of their respective owners. 4.3 The Pharmaid Natural Cosmetics UK™ website features links to other web sites. While Pharmaid Natural Cosmetics UK™ hopes the Client will be interested in those websites, we do not accept any responsibility for their content.

4.4 Pharmaid Natural Cosmetics UK™ take every care to ensure that the information on their website, leaflets and other documentation is accurate and complete. However, some of it is supplied to Pharmaid Natural Cosmetics UK™ by third parties and we are unable to check its accuracy or completeness. You are advised to verify the accuracy of any information before relying on it.

4.5 The Pharmaid Natural Cosmetics UK™ website and leaflets are provided "AS IS" without any warranties of any kind and we do not accept any liability arising from any inaccuracy or omission in the information or interruption in availability.

5. General

5.1 As a Pharmaid Natural Cosmetics UK™ Client, if you have provided us with your e-mail address, we will from time to time send you e-mails and text messages with our latest offers, products and services. Should you not require us to send you this information please either send an e-mail to info@pharmaiduk.com from the e-mail address you wish to be unsubscribed and we will remove you from our mailing list(s).

5.2 Pharmaid Natural Cosmetics UK™ will not be liable for any failures in the performance of any of their obligations under these terms and conditions caused by factors outside their control.

5.3 Pharmaid Natural Cosmetics UK™ reserve the right to restrict, suspend or terminate access to its’ website and/or services for any reason at any time. We accept no responsibility for any interruption to the Pharmaid Natural Cosmetics UK™ website and/or services for reasons beyond our control.

5.4 This current version of our Terms and Conditions of Business supersedes all prior Terms and Conditions of Business, arrangements, warranties and understandings between the Client and Pharmaid Natural Cosmetics UK™.

5.5 These Terms and Conditions of Business do not affect your common law and statutory rights.

5.6 These Terms and Conditions of Business shall be governed by and construed in accordance with English law, and any dispute shall be subject to the exclusive jurisdiction of the English courts.

6.1 Due to the United Kingdom's decision to leave the European Union (Brexit), NO products on this website can be shipped to any country within the United Kingdom (England, Scotland, Northern Ireland and Wales). We are also presently unable to ship to Belarus, Russia, Ukraine or Iran.

6.3 All international shipments from Pharmaid Natural Cosmetics UK™ to the Client are delivered under global trade international commercial terms (Incoterms® 2020) "Delivered at Place" (DAP). DAP means that Pharmaid Natural Cosmetics UK delivers when the goods are placed at the disposal of the Client on the arriving means of transport ready for unloading at the Client's named place of destination. Pharmaid Natural Cosmetics UK bears all risks involved in bringing the goods to the named place. The Client is responsible for receiving/unloading at the named place destination and any import duty, taxes and customs clearance procedures and costs which may be applicable. It is the Client's responsibility to be aware of the laws, customs regulations and any health authority approval which may be required in the country being shipped to. 

6.4 BrexitInternational Shipments to all NON-EU Countries - From January 01, 2021, all previous EU trade agreements no longer apply to the UK. Trade agreements between the UK and other countries came into effect, details of which can be found here: >> UK Trade Agreements with non-EU countries <<. Therefore, before placing an international order with Pharmaid Natural Cosmetics UK to be shipped to any NON-EU country, we encourage The Client to check with their local Customs Authority to verify acceptance of any items that they wish to import. If an order/package is seized by The Client's local Customs Authority, it is The Client's responsibility to have it released and pay any costs which may be incurred or return the package in compliance with our Refund/Cancellation/Returns Policy to Pharmaid Natural Cosmetics UK™ in order to be eligible for a refund minus the shipping costs paid by Pharmaid Natural Cosmetics UK™ or The Client whichever is the greater plus a 10% of the total order value handling charge and any customs re-importation costs which may be incurred. Knowing this risk, if an order is placed with us, The Client acknowledges that they will agree to pay for their order, regardless of whether or not they receive the package. If The Client does not receive the order, they have the right to request proof of non-delivery, including any paperwork that may accompany the return of the order. If The Client would like the order to be re-shipped, they may do so at their own risk and expense. Any charges associated with returning or disposing of a returned shipment(s), including transportation and any applicable duties, taxes and fees, will be charged to the the Client.

6.5 Brexit - International Shipments to all EU Countries - On December 24, 2020, the new EU-UK Trade and Cooperation Agreement was agreed and has been in operation since January 01, 2021, details of which can be found here: >> UK-EU Trade Agreement <<. From January 01, the trade and movement of goods between the UK and the EU became subject to the new terms and rules outlined in the Agreement. Therefore, before placing an international order with Pharmaid Natural Cosmetics UK™ to be shipped to any EU country, we encourage The Client to check with their local Customs Authority to verify acceptance of any items that they wish to import. If an order/package is seized by The Client's local Customs Authority, it is The Client's responsibility to have it released and pay any costs which may be incurred or return the package in compliance with our Refund/Cancellation/Returns Policy to Pharmaid Natural Cosmetics UK™ in order to be eligible for a refund minus the shipping costs paid by Pharmaid Natural Cosmetics UK™ or The Client whichever is the greater plus a 10% of the total order value handling charge and any customs re-importation costs which may be incurred. Knowing this risk, if an order is placed with us, The Client acknowledges that they will agree to pay for their order, regardless of whether or not they receive the package. There are certain products which cannot be shipped to the European Union. The list, which may be updated as new legislation is introduced and/or we are alerted by EU Customs Authorities that a product is no longer allowed into the EU. All products not allowed into the EU are clearly marked with a European Flag with a "No entry" sign across the flag. Should a product be purchased by The Client for shipment to the EU anyway, your order will be cancelled, a 10% handling fee charged, and the balance will be refunded.

6.6 Some countries custom requirements may require the customer to provide additional information. If you are unable to provide the requested information for the shipment, your order will be cancelled, a 10% handling fee charged, and the balance will be refunded. For example:-

Brazil - Addressee Identification Reference Number, individuals CPF in the format: 000.000.000-00 or a CNPJ for organisations in the format: 00.000.000/0000-00.

6.7 If orders are placed before 12:00 Hrs. (Mon-Friday - excluding Bank Holidays), most are generally despatched that day subject to available stock and/or volume of orders received. Packages are at the latest, dispatched within 48 working hours after receipt of payment and are shipped via The Royal Mail. During and/or just after UK Bank Holidays, this may take a little longer and we ask you to bear with us during these times. At our discretion we can ship with tracking and/or with signature or via a courier of Pharmaid Natural Cosmetics UK's choice at no additional cost the Client unless mutually agreed in writing between Pharmaid Natural Cosmetics UK and the Client. When placing your order with us, please consider that orders are only processed during Monday – Friday (excluding company holidays as detailed in item 11 of our terms of business). All orders will be shipped by the next business day after the order has been processed. Example: all orders placed on Saturday or Sunday will be processed on Monday; once the order is processed, the order will ship out by Tuesday. International orders may take a little longer due to customs paperwork since Brexit came into full effect on January 01, 2022.

6.8 Should The Client ask Pharmaid Natural Cosmetics UK to leave a delivery at a location other than delivery to The Client directly in person(s), Pharmaid Natural Cosmetics UK cannot be held responsible should the delivery become lost, examples being (but are not limited to) "Leave behind bin at side of house" or "if no one in, leave with a neighbour" etc., etc.

6.9 Pharmaid Natural Cosmetics UK are not responsible for packages lost, damaged or stolen en route to The Client, or after arrival. If The Client's package is lost or damaged, or delayed in transit, please contact us and your local delivery center immediately to report your problem and we will do our best to work with The Client to rectify the problem. A photograph should be taken by The Client immediately of any damage to the packaging and/or damaged product(s) so that this can be relayed to the relevant company who delivered the product e.g. Royal Mail, Courier etc. 

7. Opening Hours

7.1. Normal Pharmaid Natural Cosmetics UK™ contact/working hours are 10:00 to 17:00 Hours, Monday through to Friday. We do not open Saturday, Sunday or United Kingdom Bank Holidays (2 in May, 1 in August, Good Friday, Easter Monday, the annual Christmas Day, Boxing Day holidays).

7.2. As a small family run business, we also close for annual holidays during which time orders placed online cannot be processed. For Christmas 2023 we will be closed from midday on Friday December 22nd 2023 through until Tuesday January 2nd, 2024. Orders placed online during these periods will be processed and shipped from  January 2nd, 2024 respectively, in chronological order in which they were received. We apologise for any inconvenience this may cause, and ask you to bear with us during these much needed holidays.

7.3. Orders received online, are normally shipped on the same day if received before 13:00 Hrs. However, during busy periods, this may take a little longer, but we always aim to ship within 24 working hours from receipt of order. For example, if an order is placed at 4pm on a Friday, the maximum time we would aim to ship it by would be 4pm on the following Tuesday. If it is a Bank holiday weekend, it would be 4pm on the following Wednesday. This would be the worst case scenario.

8. Refund/Cancellation/Returns Policy

8.1. The Client can cancel and return their order for goods ordered via our websites anytime up to fourteen days after it has been received. Goods cannot be returned after this except as detailed in 8.4 below.

8.2. Goods should always be checked at time of delivery. Both the carrier concerned and Pharmaid Natural Cosmetics UK must be advised, in writing, otherwise than on a consignment note or delivery receipt, within three days of delivery, of any shortage, damage, incorrect products shipped or mis-delivery. If an entire consignment is not received within 21 days of invoice date, written notice must be sent to Pharmaid Natural Cosmetics UK at once. Claims received outside of these limits cannot be considered.

8.3 Certain items cannot be returned if you have changed your mind so please be aware of this before ordering (please contact us for full list) for example:

  • Face, body, haircare, skin care, sun protection, aftersun products which have been opened and/or the seals have been broken.

8.4 If the Client returns the product because they are claiming that it is defective we will examine the returned product and will notify the Client of our findings and confirm whether the Client is entitled to a refund on the grounds that the product was defective. Defective products returned by the Client will be refunded in full, including the original delivery charges charged to the Client.

8.5 The Client should ensure that the correct delivery/shipping address is entered at the time of placing an order. Pharmaid Natural Cosmetics UK cannot be held responsible for any problems or costs involved due to incorrect or inaccurate shipping information given to Pharmaid Natural Cosmetics UK by the Client when placing an order. Should a package be returned to Pharmaid Natural Cosmetics UK due to incorrect/inaccurate shipping information received, the Client will be responsible for all costs involved for re-sending the package to the Client at either the same or an alternative addressThe original carriage charge paid by the client to Pharmaid Natural Cosmetics UK cannot be refunded.

8.6 On orders where a tracking number is supplied by Pharmaid Natural Cosmetics UK to the Client, it is the responsibility of the Client to track the journey of the order and if required, arrange for re-delivery should an attempt/attempts be un-successful by the postal service/courier in the country the order is being delivered to. Should a package be returned to Pharmaid Natural Cosmetics UK™, the Client will be responsible for all costs involved for re-sending the package to the Client at either the same or an alternative address. The original carriage charge paid by the client to Pharmaid Natural Cosmetics UK cannot be refunded.

8.7 Should a client wish to return a product to Pharmaid Natural Cosmetics UK™, they should only do so by following the returns procedure >> here <<. Pharmaid Natural Cosmetics UK cannot accept returns from a client who has not correctly followed this procedure.
